Build Back Better Bill - Retroactive Inclusion

As the House of Representatives passes the Build Back Better Bill, we wanted to reach out to let anyone that has been in a Same-Sex Marriage since 2010 or before that new legislation may offer you a refund check from the IRS.

 

Since federal law did not acknowledge Same-Sex Marriage until 2013, couples that were wed earlier under state law had to file their federal tax return as single instead of as filing jointly (which typically produces a more favorable outcome for taxpayers). When the Supreme Court ruled that Same-Sex Marriage was legal across the country, couples were allowed to amend their 2011 and 2012 tax returns to change their filing status for those few years, something that is typically not allowed.

 

Under the Build Back Better Bill, couples would be allowed to amend their tax returns all the way back to 2004 to have their marriage recognized on the federal level and take advantage of the favorable tax rates. We are following these developments closely and will have more information soon but wanted to start compiling data to ensure that we are keeping all of those who would benefit informed and up to date on the positive changes at hand.
